My mom is 61 yrs old does not have insurance and just found out she needs a hip replacement. Need advice.?
The doctor told her the surgery would cost approximately $30,000. My mom is a widow, is retired from heavy highway construction after 22 years, she is cannot work right now due to poor health. (she was working part-time with her brothers who are in the commercial fishing industry on Lake Michigan, but working on the boat at her age and health is too much, so now she doesn’t even have that income). Are there any options for her to get help for this surgery. She is not old enough for Medicare or Medicaid (not sure which it is, sorry). I’m trying to get educated here so I can find her some help. She’s in a lot of pain. Any suggestions would be greatly appreciated or where we could go for help. And I don’t think she’s old enough for social security yet.
If she cannot work, she should consider applying for disability. Those on SS disability are eligible for medicare even though they aren’t 65 yrs old. Also have your mom get advice on ways to cope with the hip arthritis. There are many coping skills and things she can do to make life at least marginally bearable while she waits on surgery. Some hospitals have classes for people with arthritis and she might benefit. Also she might benefit from a regimen of physical therapist-prescribed exercises and the use of walking aid such as a cane or crutch or even a wheelchair. There are also medicines that she can take that might help relieve pain. Her doctor can advise on this.
I’ve had both of my hips replaced and can attest to the high probability of success of the surgery. It has literally changed my life and I hope your mom can benefit from the surgery as well. It is considered elective surgery because it isn’t usually done on an emergency basis and can be planned for.
Things you can do: help her see about applying for SS Disability. While she waits on the outcome of that application (it can require appeals and takes lots of time), find her an arthritis support group (check with her doctor and at local hospitals). If she doesn’t already take pain meds, have her ask her doctor for recommendations. I took Aleve at double the OTC dose upon my Dr’s recommendation and it helped me for several years. There are other possible meds to take. Next, get her a cane and have her physical therapist or doctor teach her how to use it properly. It might be worth it for her to pay for a consult with a physical therapist who could design a program of exercises that would keep the muscles around her hip strong.
I know how hip arthritis can drag a person down. I lived with gradually worsening arthritis in both of my hips for about 10 years until they were so bad that I couldn’t even walk without a cane. My world got smaller and smaller.
Best of luck to you both.
Construction accidents: Michigan's Most Dangerous Work: injured workers are often denied the recovery of damages
By Terry Cochran
Construction accidents are one of the most common types of accidents for Michigan workers and for workers throughout the nation continue because safety not to have protected. Construction workers in the building trades are often the victims of on-the-job injuries and serious accidents. Why? are too often required safety rules are not available. As a result, thousands of construction workers are killed or injured every year.
In Michigan alone, the construction industry led all others with the highest number (30) of fatal accidents in 2008, after the Michigan Occupational Health Safety and Health Administration (MIOSHA). MIOSHA reports that the dangers of leading Construction workers are given connected:
- Cave-ins
- Underground Utilities
- Heavy Machinery
- Manual handling materials
- Working near moving traffic
- Electrical hazards, such as overhead power lines
MIOSHA reports that in 1994 alone some 19 workers in Michigan trench collapse accidents have been killed.
In my practice, the common construction accidents with on-the-job injuries, Death or workers comp leaders include falls from ladders and scaffolding, front loader, electrocution, vehicle back-overs, gas line explosions, failed machines, collapses and road construction workers hit by passing vehicles. Employees are injured carpenters, roofers, dry Waller, pipe layers, Operating engineers, Rod Busters, cement finisher, cement finishers and laborers.
A construction worker injured at work, in most cases the employer for work-related injuries to sue. A third party can be shown to be liable for negligence if an injury occurs on the site. While some workers avoided or limited by law from collecting workers compensation for their injuries, many workers are able to, damages from parties other than their employers recover or colleagues, especially when sub-contractors involved. Sometimes building owners, architects, builders and manufacturers can be held liable for damages be for the construction of accidents. Mostly, however, is the responsible person of the general contractor, contractor or owner.
Manufacturer of construction equipment accounts for designing and maintaining safe products. Broken or dangerous products may be at fault in a construction accident. With all the equipment on a construction site used, the chance for injury is great, but if the right precautions, not in the production of these devices, the chances of an injury or a Death occurring increase are busy.
The manufacturer of this device can be found liable if an accident due to one of their products occurs. The equipment at a construction site includes scaffolding, cranes, power tools, derricks, hoists, conveyors, woodworking tools, Ladders, winches, trucks, graters, scrapers, tractors, excavators, forklifts, back hoes, heavy equipment, boilers, pressure vessels and gas detectors.
Even if a worker is injured because of his or her own negligence, compensation may still of the Workers Compensation Act is available. Benefits such as workers comp weekly payments and medical payments to an injured worker awarded, although these distinctions are not often enough to the pain and suffering, with a On-the-job injuries come.
Workman's Comp weekly payments on a percentage of the employee's weekly earnings and on the severity of disability, whether temporary or partial disability, total permanent disability. The medical cover only those treatments deemed necessary and in terms on the specific work injury.
Because construction accident cases are usually very complex, it is important to consult with an attorney with experience in the investigation of Accidents and construction in the evaluation of the best avenue of recovery on the rule of law. When consulting the employee's application for layout, a workers comp attorney.
Insurance claims are often denied the only way insurance companies can achieve their profit goals. Workman comp claims are often denied, especially when first time I strongly advise Michigan construction workers involved in an accident to a qualified attorney in Michigan to use construction accident recovery, because the law varies from state to state. An attorney will guide you through the steps necessary to recover actual damages and perhaps even assist in imposing punitive damages.
